E-Verify is a free internet-based program operated by the United States Department of Homeland Security (DHS) and Social Security Administration (SSA) that is used by employers to verify the work authorization of newly hired employees pursuant to federal law. Employers submit information from the I-9 form for every new hire and that information is compared with DHS and SSA records to determine if the individual is eligible to work in the United States. It applies to certain federal contractors but also has been adopted by many states, including North Carolina.
North Carolina's E-Verify Rule
As of July 1, 2013, all private employers with 25 or more employees are required to E-Verify new hires. However, seasonal workers who work less than 9 months in a calendar year are not counted towards the 25-worker threshold.
Private employers in North Carolina are required to verify the employment eligibility of current employees if the employer has been awarded a federal contract on or after September 8, 2009 that contains the Federal Acquisition Regulation (FAR) E-Verify clause.
Substantial monetary penalties can be assessed by the N.C. Commissioner of Labor for violations of North Carolina's E-Verify Law and range from $1,000 to $10,000 per violation.
